looking into an overnight stabbing. menlo park police helping with the investigation. they tell us at least one person was stabbed multiple times, a total of four people are being questioned. police not saying anything else at this point. we do have a crew on the scene gathering more information as we speak. if we learn anything else we'll pass it along to you. >> new this morning an earthquake shook parts of southern california overnight. the usgs says a 3.2 quake hit near beverly hills about 3:30 this morning. it was felt up to eight miles away from the epicenter. no reports of damage. according to the l.a. times, in the past 10 days there has been one earthquake 3.0 or greater centered in that area. >> this morning upsetting news for people in a bay area community who survived a fire storm.

vandals. christie smith is live in oakland with why investigators say the vandals may be targeting this sculpture. good morning. >> reporter: good morning, jon. this is the centerpiece of the fire storm memorial garden near highway 13, this is the area that burned. the sculpture means a lot to people who live around here so you have to wonder what someone was thinking when they came in and cut five of these metal posts off. not only did they do that but they did it steps away from the sign that shows that there are security cameras watching what people are doing. this committee that developed the garden is hoping that the tapes will help identify the people responsible for this. and it goes from bad to worse. this is the third time the sculpture has been vandalized. the metal possibly for scrap, this time the vandals hit overnight saturday, early

sunday. it represents burn trees and regrowth after the fire storm where more than 3,000 homes were lost. the committee is trying to raise $5,000 to maintain the video system and also go ahead and repair the sculpture. reporting live, christie smith, "today in the bay." >> good news the dumbarton bridge could be ahead of schedule getting ready for tomorrow's commute. good weather helping crews make outstanding progress on the seismic retro knfit going on al weekend. joint is said to be more flexible and withstand stronger earthquakes. if you need to get from one side of the bay to the other before tomorrow morning, your best bet now is the san mateo bridge. >> crime is sky rocketing in the south bay and this morning a community is coming together to stop it. bob redell is live in san jose with more on a peace march planned for this morning.

distingui good morning. >> reporter: this peace march is to bring attention to the recent spike in violence and the people they want to get this message to, the young people. the people who are organizing want young people to know that they are there for them, there to help. this will take place, start at this safeway. now this location is significant because the scene of the 31st homicide. it was under two weeks ago a 27-year-old man went into the store and attack add 24-year-old man in one of the aisles. he stabbed the man in the chest, he ended up dying, being the eighth person to be murdered in the city of san jose over just an 11-day period. >> we want to get everyone together and to say we're fed up and let them know that we care about them, we care about their

future, we care about each other as a community. that we can bring peace to san jose. >> reporter: this peace march organized by people who live here in east san jose starting at this safeway, the scene of the 31st homicide this year. and it will end at lake cunningham. reporting live, bob redell, "today in the bay." >> a san jose fire fight here suffered a heart attack in the line of duty fiding a far last week appears to be making progress. dozens of friends and family have been holding a vigil for frank ryan every day since last thursday. ryan remains in critical but stable condition. yesterday about 75 people holding a vigil for ryan giving thanks to all first responders who risk their lives to help others. >> these men and women put their lives on the line for us.

you call 911, they're there. they call for the church we wanted to be there. the love and support that they show us. >> ryan's family saying quote frank is progressing 18 positive way, we are taking it one day at a time given the circumstances surrounding his condition. >> there are also prayers for frank ryan at st. patrick's cathedral in san jose. the church where he nearly died last week. more than 200 packed the gym at the school where they had to hold sunday's mass because the church was heavily damaged. >> this is that church, you know, this is their family and where they come every sunday to worship and be with each other as a community. so the church is no longer but the community still remains very strong. >> the cause of that fire remains under investigation.

christie smith is live in oakland with a look at what's being done to restore this memorial. good morning. >> reporter: good morning to you. this is really painful for people who lived through the oakland hills fire storm in 1991. as you said, this isn't the first time that someone vandalized the memorial sculpture. it's the third time. and this time someone cut off five of the metal poles here. despite the fact if you look here, there are clear signs saying that there are security cameras in use. the committee that developed the fire storm memorial garden is hoping that the tape from the cameras might identify a suspect. overnight saturday or early sunday someone took the poles down, they cut them, possibly to sell for scrap. they represent trees and regrowth from the oakland hills fire storm where 3,000 homes were lost and 25 people died. the committee is trying to now raise about $5,000 to help

maintain the security system they have, perhaps upgrade it and try and repair the sculpture. reporting live, christie smith, "today in the bay." >> a man is dead after another officer-involved shooting in vallejo. around 4:30 sunday morning officers spotted two men sitting in a car on pepper drive near highway 37. it's an area known for gang activity. police say the driver got out of the car and reached for what he thought was handgun. that's when officers opened fire. they say the suspect would not surrender and reached toward the center of the car. the officers then fired several more shots. the driver died at the scene. his passenger was also hit. this morning he is recovering at the hospital. police searched the car and found an air gun and 50 pills. both officers have been placed on leave. >> south bay residents fed up with a spike in deadly violence are taking to the streets with a

message of peace. bob is live in san jose with more on this march. and the message participants hope to send out to the public. good morning. >> reporter: good morning. this is the community's way of letting the public know that they are just, as you mentioned, fed up with the recent strike in violence, that they are tired of it and this march will start around 11:00 at this safeway here in story and white road, this is significant because this is the scene of where the city's 31st hm side took place a. 24-year-old man just under two weeks ago, killed by a 27-year-old man. apparently the 27-year-old man stabbed the younger man in one of the aisles in the store, using a knife stabbing him in the chest. he did end up dying. he was the eighth person to be killed within the city limits. over an 11-day period.

>> for san jose just to bring focus on the violence that's plaguing our city and we just want to get the youths out there and the community out there and show them that we can work together. >> reporter: this march for peace starting at 11:00 this morning at this safeway. they will head over to lake cunningh cunningham. bob redell, "today in the bay." >> 6:35. oakland mayor jean quan could soon be in trouble with the law. attorneys may put the police department under federal control want quan to show up for a deposition. the attorneys have asked a judge to place her in contempt of court if she does not show. they are trying to place the department under federal control for failing to fully implement reforms. >> 6:35. this morning fire ves kbers trying to figure out why two

homes went up in flames. this happened yesterday morning, the fire spread to the next home before crews arrived. one thing investigators will look into is whether a blow-out ot a fire house delayed response time. two families remain homeless. the red cross is helping with necessities. >> the south bay dui check points are netting fewer drunk drivers than last year. this is from a check point in san jose. officers arrested 294 people for driving under the influence over 116 days. it will continue through tonight. last year the number for the same time period was 373. if you do the matt math that's a difference of almost 80 arrests. >> 6:36. it looks like a perfect day to have a labor day holiday.

mother nature shuttinging down light on our barbecues. >> she wants us to go big. good morning. temperatures are looking good today. this is the reason why. we have such a cool setup. high pressure is forcing the marine layer to the surface. you can see the city here, but over the bay completely socked in with fog. let's show you what that looks like now on the golden gate bridge. you saw the high towers peeking up. right at the surface very, very low visibility this morning. you're between a quarter mile and a half mile but not for long. that that rein layer a quick hook at your drive, he's right around the corner. 55 in concord and livermore. 58 degrees in sanç jose. west conditions will be here in santa cruz at the beach. 80 degrees at 4:00 almost. and just about everywhere it's going to be right on track.

the only thing we aren't getting that we do this time of year is that thick fog, it's going to clear by about 10:00 a.m. you'll hit 73 as a result. your seven-day does reveal pretty subtle changes but we want to take you through those as promised. here is anthony. >> we still have that accident on 880 a at alvarado road. that has not slowed traffic. it's working its way over to the shoulder. so use caution if you are working north into oakland f. you are headed into the city from oakland you can see we're looking at slow downs. there is an accident on the upper deck heading toward the island. as we look outs we're not looking at major slowdowns. the metering lights have not been turned on yet. a good indication things are going to move smoothly as we head into the next couple of hours. >> all the commuters are tucked away in bed as they should be.
